Terms of Service

The short version

Swanvista is a read-only tracking and educational analytics tool for your own money. We summarize and suggest — we never trade, place orders, or move money, and nothing in the product is investment advice. You own your data and can export or delete it at any time. Numbers can be delayed or wrong, so verify anything important with your broker, bank, or a licensed professional. The Service is currently free; when paid plans launch, they will renew automatically and you will be able to cancel anytime in the app.

1. Who we are and what these terms cover

These Terms of Service (the "Terms") are a binding agreement between you and Swanvista, an independently operated service ("Swanvista", "we", "us"). They govern your access to and use of the Swanvista websites (swanvista.com), the Swanvista application (app.swanvista.com), and the emails, analytics, and related services we provide (together, the "Service").

By creating an account or using the Service, you agree to these Terms — and where an acceptance checkbox is presented at signup, checking it records your express consent to them. You also agree to our Privacy Policy, Subscription & Refund Policy, and Acceptable Use Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 18 years old to use the Service. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.
  • The Service is offered to residents of the United States. We make no representation that it is appropriate or available elsewhere.
  • You may maintain one account, for yourself. You may only connect financial accounts that you own or are legally authorized to access.

3. What Swanvista is — and what it is not

Swanvista is a privacy-first tracking and educational wealth-analytics tool. It lets you see your net worth across accounts, organize your investments into "sleeves" with targets you set yourself, configure your own risk guardrails, and receive summaries and analytics about your own plan — including the SwanScore plan-health score, wealth brief emails, dividend tracking, trading analytics, projections, and tax-estimate reports.

The Service is read-only. Swanvista never places trades or orders, never executes transactions, never transfers or withdraws funds, and never takes custody of your money, securities, or crypto assets. Connections to your financial institutions are established through third-party providers on a read-only basis, and crypto wallets are tracked by public address only. We summarize and suggest; we never trade or move money. Any action you take in your brokerage, bank, or wallet is yours alone, taken outside the Service.

4. Not investment, tax, or legal advice

Swanvista is not a registered investment adviser, broker-dealer, financial planner, tax advisor, or fiduciary and is not registered with the U.S. Securities and Exchange Commission, FINRA, or any state securities regulator. Nothing in the Service is, or should be treated as, individualized investment advice or a recommendation to buy, sell, or hold any security, crypto asset, or other financial instrument.

The analytics the Service produces — including sleeve targets and drift figures, rebalancing amounts, guardrail statuses and alerts, SwanScore factors and tips, projections, and the suggestions in your wealth brief — are informational and educational computations measured against the targets, guardrails, and plan settings you configured. They describe how your holdings compare to your own self-set plan; they are not our assessment of what you should buy or sell, and they do not take account of your full financial situation, needs, or objectives. Default settings offered during onboarding are generic starting templates, not personalized recommendations.

Before making any investment, tax, or other financial decision, consult a licensed professional who can evaluate your individual circumstances. You are solely responsible for your investment decisions and their outcomes.

5. Data accuracy — no reliance

Balances, prices, holdings, returns, dividends, analytics, projections, and tax figures shown in the Service come from third-party data providers and your linked institutions, and from calculations built on that data. They may be delayed, estimated, incomplete, or inaccurate. Market data may be end-of-day or otherwise delayed rather than real-time. Tax figures are rough estimates for planning conversations, not tax advice, and must not be used to prepare or file a tax return.

Always verify balances, positions, cost basis, and tax amounts with your broker, bank, or tax professional before acting. We do not warrant that any figure in the Service is accurate, complete, or current, and we are not responsible for decisions made in reliance on it.

6. Your account and security

  • You must provide accurate registration information and keep it current.
  • You are responsible for safeguarding your login credentials and for all activity under your account. We strongly encourage enabling multi-factor authentication.
  • Notify us promptly at support@swanvista.com if you suspect unauthorized access to your account.

7. Linked accounts and third-party connections

You may connect bank, brokerage, and other financial accounts to the Service through third-party providers such as Plaid and SnapTrade, and add crypto wallets by public address. By linking an account you authorize us and those providers to retrieve your account data (balances, holdings, transactions) on a read-only basis and to refresh it periodically until you disconnect the account.

  • Your institution login credentials are entered directly with the connection provider — Swanvista never receives or stores your bank or brokerage username or password.
  • The access tokens providers issue to us are encrypted at rest.
  • You can disconnect a linked account at any time in the app, which stops further data collection from it.
  • Your use of a connection provider is also subject to that provider's own terms and privacy policy (see our Privacy Policy for links).
  • We are not responsible for the acts, omissions, outages, or data errors of your financial institutions or the connection providers.

8. Subscriptions, billing, and refunds

The Service is currently offered free of charge; there are no paid plans today. When paid subscriptions are offered, prices and plan features will be shown at checkout and on our pricing page, paid plans will be billed in advance on a recurring basis and will renew automatically until cancelled, and you will be able to cancel at any time in the app, with cancellation taking effect at the end of the current billing period. Full billing-cycle, renewal, cancellation, and refund terms — including the 30-day refund window on a first purchase — are in our Subscription & Refund Policy, which is part of these Terms and takes effect when paid subscriptions launch.

9. Acceptable use

You agree to use the Service only as permitted by our Acceptable Use Policy. In short: one account per person; only link accounts you are authorized to access; no scraping, bulk automated access, or redistribution or resale of market data or analytics; no interference with the Service or its security; no unlawful use. We may suspend or terminate accounts that violate it.

10. Your data; our intellectual property

You own your data. As between you and Swanvista, you retain all rights in the financial data, entries, notes, and settings you provide to the Service or authorize us to retrieve. You grant us a limited, non-exclusive license to host, process, and display that data solely to provide, secure, and improve the Service for you. You can export your data (CSV) and delete your account — which permanently deletes your data as described in the Privacy Policy — at any time from within the app.

We own the Service. The Swanvista software, product design, analytics methodologies (including the SwanScore), text, graphics, logos, and branding are owned by Swanvista or its licensors and are protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights in the Service are granted to you. You may not copy, modify, reverse engineer, or create derivative works of the Service except where that restriction is prohibited by law.

If you send us feedback or suggestions, we may use them without restriction or obligation to you.

11. Third-party services and market data

The Service displays data obtained from third-party market-data providers and financial institutions. That data belongs to its providers, is provided for your personal, non-commercial use within the Service, and may not be redistributed, republished, or resold. Third-party services linked from or used within the Service are governed by their own terms.

12. Changes to the Service; availability

We may add, change, or remove features of the Service, and we may suspend or discontinue the Service in whole or in part. We aim for high availability but do not promise the Service will be uninterrupted, timely, or error-free. Scheduled data refreshes (for example, end-of-day snapshots) may be delayed or missed.

13. Termination

You may stop using the Service and delete your account at any time in the app. We may suspend or terminate your access if you materially breach these Terms (including the Acceptable Use Policy), if required by law, or if we discontinue the Service; where practical we will give you notice and an opportunity to export your data. Sections that by their nature should survive termination (including Sections 4, 5, 10, 11, and 14–18) survive.

14. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ANY DATA, FIGURE, ANALYTIC, OR PROJECTION IN THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER SWANVISTA NOR ITS OFFICERS, MEMBERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, INVESTMENT RETURNS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS — INCLUDING ANY TRADING OR INVESTMENT DECISION MADE IN CONNECTION WITH INFORMATION SHOWN IN THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (ii) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THE LIMITATIONS IN THIS SECTION APPLY TO ALL THEORIES OF LIABILITY AND ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US.

16. Indemnification

You will indemnify and hold harmless Swanvista and its officers, members, and employees from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party in connection with your use of the Service.

17. Governing law and disputes

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-laws rules. The state and federal courts located in Massachusetts will have exclusive jurisdiction over any dispute arising out of these Terms or the Service, and each party consents to personal jurisdiction and venue there. Nothing in this section limits any non-waivable consumer rights under the laws of your state of residence.

Before filing a claim, you agree to first try to resolve the dispute informally: email support@swanvista.com with a description of the dispute, and we will work with you in good faith to resolve it within 30 days before either party starts a formal proceeding.

18. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you (for example, by email or an in-app notice) at least 14 days before it takes effect. Continued use of the Service after the effective date of an updated version constitutes acceptance. If you do not agree to a change, stop using the Service and delete your account before the change takes effect.

19. General

  • These Terms, together with the policies incorporated by reference, are the entire agreement between you and Swanvista regarding the Service.
  • If any provision is held unenforceable, the remainder stays in effect and the provision will be enforced to the maximum extent permitted.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices to you may be given by email to the address on your account or through the Service.
